3 - YEAR LIMITED WARRANTY
Artinox SA – Fábrica Metalurgica with head office in Rua Fonte Moura 3754-908 Aguada de Cima, Portugal, with VAT No. PT500712255 (hereinafter “Artinox”) with this declaration issues the following warranty (hereinafter “Warranty”) regarding its Standard lighting products.
Produtos
This warranty applies to standard Artinox products from the General including permanently installed ballasts or operating units or components (LED modules, drivers, power supply units, transformers etc.)
The Warranty cover custom-made products, conventional and LED retrofit illuminants or metal components that can be ordered separately.
Duration of the Warranty
Artinox warrants that its Products are free from manufacturing and/or material defects for a period of 3 (three) years from the invoice date. This guarantee shall apply to products delivered from September 2019.
Warranty Condition
The validity of the warranty is subject to verification that:
- The Products are used in compliance with the relevant Product specifications and relevant use (technical specifications);
- The product is used in accordance with the pertinent technical specifications and in compliance with applicable law and standards (in particular in accordance with data sheets, application guidelines,) (intended use);
- The ambient temperature and power voltage neither exceed nor fall short of the tolerances stated in the product and application specifications (data sheet of the electrical component);
- No modifications in deviation from the product’s condition on delivery (e.g. replacement with third party components) have been made; updates and addition of functions may be made solely by Artinox;
- The Product need to be installed and maintained by qualified technicians in compliance with the instructions accompanying the Product;
- The Product is not modified/repaired without prior written authorization or observance of the instructions accompanying the Product;
- The defective Product is stored by the Customer as is (including the light source) for the time required by Artinox to conduct the necessary inspections on the reported defects/faults;
- Regular maintenance and cleaning of the product in accordance with the requirements of Artinox (Cleaning and Installation instructions) or generally accepted procedures have been carried out;
- The product has not been subjected to any mechanical or chemical stress that is not in accordance with its intended use; it may not to this extent and in particular either come into contact with substances whose properties, according to general knowledge, are capable of impairing the functionality of the lamp (cleaning agents, bases and acids, salt etc.) or be exposed to extreme ambient conditions such as sea or desert factors, in industrial operations or animal husbandry operations; warranty covering any failures caused by such factors is subject to the prior written agreement with Artinox.
- The defect – once it has been duly specified and its nature and extent has been proven – is reported in writing by the Customer to Artinox within thirty (30) days from its discovery, under penalty of loss of the warranty coverage;
The warranty terms exclusively refer to a defect higher than the nominal defect rate of 0.2% for 1000 hours of use. A drop in the light flow of the LED modules is normal up to a value of 0.6% for 1000 hours of use and therefore, is not covered by the Warranty. Due to technical progress as well as alteration of the light flow of the products due to use, in case of subsequent supplies of LED light sources, there may be deviations from the primitive products regarding the light characteristics.
The Warranty is valid for the first installation and not for subsequent installations.
The Warranty is valid for products with CE marking and provided directly by Artinox or from an official representative company.
Exclusions
Artinox informs the Customer that the Warranty does not cover:
- Damage that is caused by unintended or improper use of the lamp, e.g. damage and contamination resulting from inadequate maintenance/cleaning, damage from mechanical violent impacts.
- Damage caused by electricity supply conditions, including short-term voltage surges, overvoltage/undervoltage;
- Modifications alterations or repairs performed by personnel not authorized by Artinox.
- Damage caused by force majeure;
- Components and parts that are subject to wear and tear or natural ageing such as gaskets, plastic parts, connection cables.
- Costs and damage if no defect in the product can be determined;
- Indirect damage or loss occurring during the remedy of defects (e.g. removal and re-installation of the lamps, travel expenses, lifting devices, scaffolding, lost profit, losses from operational disruptions); any such costs shall be borne by the customer. In all other respects, any and all liability for damages is excluded, in particular, but not limited to, liability for consequential damage or loss.
Artinox shall inform the Customer that, failing the activation of the Warranty as provided for in paragraph (3) number 10 above, the terms and conditions relating to the warranty as specified in the sale agreement are valid and applicable.
Furthermore, any and all other causes of damage or loss that are not under our control or that represent user’s fault are excluded.
Other
This warranty does not cover product failures that have previously been remedied under the warranty through replacement, repair or price reduction.
Artinox reserves the right to make a final decision regarding the validity of a warranty claim.
Warranty performances do not extend the original warranty period or cause a new warranty period to commence. The warranty period for installed replacement parts expires concurrently with the warranty period for the product as a whole.
Without prejudice to what is set forth in point above, the Customer can make no claims against Artinox in relation to the faulty/defective Product. In particular, the Customer may not claim from Artinox any expenses relating to the storage of the defective/faulty Product or any other costs and/or compensation. Moreover, the Customer shall not have the right to request and/or claim any payment extensions, price reductions or termination of the supply contract.
The legal relationship with respect to the warranty is governed solely and exclusively by Portuguese law.
